Colombia: The Constitutional Court rendered a decision on a case in which ADC took part as an amicus curiae

In early August, the Constitutional Court of Colombia dismissed the defamation action brought by famous Colombian youtuber Kika Nieto against “Las igualadas” YouTube channel, an opinion forum managed by El Espectador newspaper. The Court held that the comments made to Nieto by the channel were protected under the right to freedom of speech. ADC supported the view of “Las igualadas” through the submission of an amicus curiae report which developed various arguments on the characteristics of freedom of speech on the internet, and the way in which classical standards must be applied to digital technologies.
